ONE-YEAR LIMITED PRODUCT WARRANTY & LIMITATION OF LIABILITY

Applies to: Sani Canada Inc. products sold in Canada
Warranty Period: One (1) year from the original date of purchase

1. LIMITED WARRANTY

Sani Canada Inc. ("Sani Canada", "we", "us" or "our") warrants to the original purchaser that Sani Canada products are free from defects in materials and workmanship when used under normal residential conditions and properly installed, operated, maintained and serviced in accordance with Sani Canada's installation instructions, care instructions and applicable plumbing requirements.

Unless a different warranty period is expressly stated in writing by Sani Canada for a specific product, all Sani Canada products are covered by a one (1) year limited warranty from the original date of purchase.

This warranty applies to Sani Canada's entire collection, including, without limitation:

  • Faucets and kitchen faucets;

  • Bathroom faucets and lavatory faucets;

  • Shower systems, shower valves, trims, hand showers and showerheads;

  • Toilets, toilet components and toilet accessories;

  • Bidets and bidet-related products;

  • Kitchen sinks and bathroom sinks;

  • Bathtubs and related components;

  • Shower doors and shower enclosures;

  • Shower bases and related products;

  • Vanities and bathroom furniture;

  • Mirrors and medicine cabinets;

  • Bathroom accessories;

  • Drains, strainers and plumbing accessories;

  • Installation components supplied with Sani Canada products;

  • Cartridges, valves, seals, washers, hoses and other working components;

  • Electronic and electrical components supplied with Sani Canada products; and

  • Product finishes and decorative components.

The warranty applies to defects in the product that existed at the time of manufacture and become apparent during the applicable warranty period.

2. FINISHES AND COMPONENTS

All Sani Canada finishes are covered for one (1) year from the original date of purchase against manufacturing defects in the finish under normal use.

This includes, where applicable:

  • Chrome;

  • Matte Black / Black;

  • White;

  • Brushed Gold;

  • Gold PVD;

  • Rose Gold;

  • Brushed finishes;

  • Polished finishes; and

  • Other finishes offered by Sani Canada.

Plastic components, decorative components and other supplied components are also covered for one (1) year against manufacturing defects.

Normal changes in appearance caused by use, cleaning, water conditions, mineral deposits, chemicals, abrasion, scratching, fading or environmental exposure are not considered manufacturing defects.

3. INSTALLATION REQUIREMENT

To maintain the validity of this warranty, Sani Canada products must be installed in accordance with:

  1. Sani Canada's installation instructions;

  2. Applicable manufacturer's requirements;

  3. Applicable plumbing codes;

  4. Applicable building codes;

  5. Applicable laws and regulations; and

  6. The requirements of the applicable jurisdiction.

Sani Canada strongly recommends that plumbing products be installed by a qualified, licensed or certified professional plumber, as required by applicable law.

Where applicable law requires installation by a licensed or qualified professional, failure to comply with that requirement may invalidate the warranty.

Sani Canada is not responsible for defects, leaks, damage or failures resulting from improper installation, installation contrary to Sani Canada's instructions, inadequate support, improper connections, incorrect rough-in dimensions, excessive water pressure, improper drainage or other installation-related conditions.

4. PROPER USE AND MAINTENANCE

The product must be used only for its intended purpose and maintained in accordance with Sani Canada's care and maintenance instructions.

The warranty does not cover damage resulting from:

  • Abuse;

  • Misuse;

  • Neglect;

  • Accidental damage;

  • Improper maintenance;

  • Improper cleaning;

  • Improper repair;

  • Unauthorized modification;

  • Alteration of the product;

  • Use of non-approved replacement parts;

  • Commercial or industrial use where the product was not designed or approved for such use;

  • Improper water pressure or temperature;

  • Freezing or frost damage;

  • Electrical surges;

  • Improper electrical connections;

  • Exposure to unsuitable environmental conditions; or

  • Any use contrary to the manufacturer's instructions.

5. CLEANING PRODUCTS AND CHEMICAL DAMAGE

Sani Canada products should be cleaned only with products and methods recommended by Sani Canada.

Do not use:

  • Acid-based cleaners;

  • Abrasive cleaners;

  • Abrasive sponges;

  • Steel wool;

  • Metallic pads;

  • Solvents;

  • Alcohol-based cleaners;

  • Disinfectants not approved for the product;

  • Bleach or chlorine-based products unless specifically approved;

  • Powdered cleaners;

  • Harsh chemical cleaners; or

  • Any cleaning product capable of damaging the product or its finish.

Damage caused by improper cleaning products, chemical exposure, abrasive materials or improper cleaning methods is not covered by this warranty.

6. WATER QUALITY

Sani Canada products are designed for normal potable water conditions.

This warranty does not cover damage, deterioration, staining, clogging, malfunction or failure caused by:

  • Hard water;

  • Calcium or lime deposits;

  • Mineral deposits;

  • Sediment;

  • Rust;

  • Iron;

  • Corrosive water;

  • Aggressive water conditions;

  • Contaminants in the water supply; or

  • Foreign materials entering the plumbing system.

Where appropriate, the purchaser is responsible for installing and maintaining suitable filtration, water treatment or sediment-control equipment.

7. NORMAL WEAR AND TEAR

This warranty does not cover normal wear and tear.

Examples include, without limitation:

  • Normal deterioration of seals and washers;

  • Cosmetic scratching caused by ordinary use;

  • Minor changes in finish caused by use;

  • Normal discoloration caused by water conditions;

  • Replacement of routine maintenance components;

  • Wear to moving components caused by normal use; and

  • Other deterioration that occurs naturally through ordinary use.

8. SHIPPING, DELIVERY AND INSPECTION

The purchaser should inspect the product promptly upon delivery and before installation.

Any visible shipping damage, missing components or incorrect products should be reported to the retailer or authorized Sani Canada seller as soon as reasonably possible and, where applicable, before installation.

Sani Canada is not responsible for damage that occurs during transportation when transportation is arranged by a third party or carrier, except to the extent required by applicable law or expressly agreed to in writing by Sani Canada.

Products should not be installed if visible damage is present.

Installation of a visibly damaged product may affect the warranty claim.

9. WARRANTY CLAIM PROCEDURE

To make a warranty claim, the original purchaser must contact the authorized Sani Canada retailer, distributor or Sani Canada directly, as instructed by Sani Canada.

The following information may be required:

  • Original proof of purchase;

  • Purchase date;

  • Product model number;

  • Product serial number, where applicable;

  • Description of the alleged defect;

  • Photographs or videos of the product and defect;

  • Installation information;

  • Name of the installer;

  • Proof of professional installation where applicable; and

  • Any other information reasonably requested by Sani Canada.

Sani Canada reserves the right to inspect the product and determine whether the reported condition is covered by this warranty.

Where reasonably required, the purchaser must provide access to the product for inspection.

10. WARRANTY REMEDY

If Sani Canada determines that a product or component is defective and the claim is covered by this warranty, Sani Canada may, at its sole option and subject to applicable law:

  1. Repair the defective product or component;

  2. Provide a replacement part;

  3. Replace the defective product with the same model;

  4. Replace the defective product with a reasonably comparable Sani Canada product if the original product has been discontinued or is unavailable; or

  5. Provide another remedy required by applicable law.

Sani Canada reserves the right to determine whether a product should be repaired or replaced.

Replacement products or components may differ in colour, finish, design or specifications where the original product is discontinued or unavailable.

Any replacement product or component supplied under this warranty will be covered only for the remaining portion of the original warranty period, unless otherwise required by applicable law.

11. LABOUR, REMOVAL AND REINSTALLATION

Unless expressly agreed to in writing by Sani Canada or required by applicable law, this warranty does not cover:

  • Labour costs;

  • Plumbing service charges;

  • Installation costs;

  • Removal costs;

  • Reinstallation costs;

  • Contractor costs;

  • Service-call charges;

  • Access costs;

  • Costs to open walls, ceilings or floors;

  • Costs to remove tiles, stone, marble, cabinets, vanities or other materials;

  • Costs associated with repairing surrounding property; or

  • Costs associated with returning the product to its original condition.

Sani Canada is not responsible for damage to surrounding materials or property caused during installation, removal, repair or replacement of a product.

The purchaser is responsible for ensuring that the product remains reasonably accessible for servicing.

12. ACCESS TO CONCEALED PRODUCTS

Sani Canada is not responsible for costs associated with gaining access to a product installed behind or within:

  • Walls;

  • Ceilings;

  • Floors;

  • Tile;

  • Stone;

  • Marble;

  • Cabinets;

  • Vanities;

  • Millwork;

  • Other building materials; or

  • Other permanent structures.

The cost of providing reasonable access to the product is the responsibility of the purchaser, subject to applicable law.

13. PRODUCTS INSTALLED IN COMMERCIAL APPLICATIONS

Unless Sani Canada provides a different written warranty for a particular product, products installed in commercial, institutional, hospitality, rental, multi-residential or other non-residential applications are covered by this warranty for one (1) year from the original date of purchase.

Commercial applications may be subject to more demanding conditions than residential applications. Sani Canada reserves the right to identify products that are not suitable for particular commercial applications.

14. ORIGINAL PURCHASER AND TRANSFERABILITY

This warranty is provided to the original purchaser of the product and is generally non-transferable.

Proof of purchase is required to establish the beginning of the warranty period.

The warranty period begins on the original date of purchase shown on a valid proof of purchase.

Where applicable law provides additional rights to subsequent owners or purchasers, those rights remain unaffected.

15. PURCHASE FROM AUTHORIZED SELLERS

Sani Canada reserves the right to limit warranty service to products purchased through Sani Canada or an authorized Sani Canada distributor, retailer or dealer, except where prohibited by applicable law.

Products purchased through unauthorized channels may not be eligible for warranty service.

16. MODIFICATION OR REPAIR

This warranty does not cover products that have been:

  • Modified;

  • Altered;

  • Disassembled improperly;

  • Repaired by an unauthorized person;

  • Combined with incompatible components;

  • Installed with non-Sani Canada components where the resulting condition causes the defect; or

  • Otherwise changed from the condition in which the product was supplied by Sani Canada.

17. EXCLUSIONS

This warranty does not cover defects, failures, damage or loss resulting from:

  • Improper installation;

  • Improper use;

  • Abuse or misuse;

  • Negligence;

  • Accidents;

  • Unauthorized repairs;

  • Unauthorized modifications;

  • Improper maintenance;

  • Improper cleaning;

  • Normal wear and tear;

  • Hard water;

  • Mineral deposits;

  • Sediment;

  • Corrosive water;

  • Freezing;

  • Excessive water pressure;

  • Electrical problems;

  • Power surges;

  • Acts of nature;

  • Fire;

  • Flood;

  • Earthquake;

  • Structural movement;

  • Construction conditions;

  • Improper drainage;

  • Foreign materials in plumbing lines;

  • Failure to follow installation or maintenance instructions;

  • Use of unsuitable chemicals or cleaners;

  • Commercial use where not approved;

  • Product relocation after installation;

  • Damage during removal or reinstallation; or

  • Any other condition outside Sani Canada's reasonable control.

18. GLASS PRODUCTS

For products containing glass, including shower doors, shower enclosures and mirrors, the warranty covers manufacturing defects in the glass and related components during the applicable warranty period.

The warranty does not cover glass breakage or damage caused by:

  • Impact;

  • Accident;

  • Improper handling;

  • Improper installation;

  • Structural movement;

  • Improper support;

  • Modification;

  • Installation contrary to Sani Canada's instructions; or

  • Damage occurring after installation.

Glass is an inherently breakable material and must be handled, installed and maintained appropriately.

19. ELECTRONIC AND ELECTRICAL COMPONENTS

Electronic and electrical components supplied with Sani Canada products are covered under the same one-year limited warranty unless a separate written Sani Canada warranty states otherwise.

The warranty does not cover damage caused by:

  • Incorrect electrical connections;

  • Improper voltage;

  • Power surges;

  • Lightning;

  • Water intrusion caused by improper installation;

  • Unauthorized modification;

  • Improper grounding; or

  • Installation contrary to applicable electrical codes.

All electrical work must be performed in accordance with applicable laws and electrical codes.

20. SANI CANADA'S EXCLUSIVE WARRANTY

To the maximum extent permitted by applicable law, this warranty constitutes Sani Canada's limited warranty for the products described herein.

Except for rights that cannot lawfully be excluded or limited, Sani Canada does not provide additional express or implied warranties beyond those expressly stated in this warranty, including implied warranties of merchantability, fitness for a particular purpose or other implied warranties.

Nothing in this warranty is intended to exclude, restrict or limit any consumer protection, statutory warranty, remedy or other right that cannot legally be excluded, restricted or limited under applicable federal, provincial or territorial law.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Sani Canada's responsibility for a defective product is limited to the remedies expressly provided under this warranty.

To the maximum extent permitted by applicable law, Sani Canada shall not be responsible for indirect, incidental, special, exemplary, punitive or consequential losses or damages arising from or relating to a Sani Canada product, including, without limitation:

  • Loss of use;

  • Loss of income;

  • Loss of revenue;

  • Loss of profits;

  • Business interruption;

  • Loss of goodwill;

  • Loss of business opportunity;

  • Additional accommodation costs;

  • Water damage or resulting property damage not directly caused by a manufacturing defect in the Sani Canada product;

  • Costs associated with removing or replacing surrounding materials;

  • Costs associated with installation or reinstallation;

  • Labour charges;

  • Contractor charges; or

  • Other consequential expenses.

To the maximum extent permitted by applicable law, Sani Canada's total aggregate liability relating to a product shall not exceed the original purchase price actually paid for the affected Sani Canada product.

Nothing in this section limits or excludes liability to the extent such limitation or exclusion is prohibited by applicable law, including any liability that cannot legally be waived or limited.

22. NO WARRANTY FOR INSTALLATION WORK PERFORMED BY OTHERS

Sani Canada manufactures and supplies products. Unless Sani Canada expressly agrees otherwise in writing, Sani Canada does not warrant installation services performed by independent plumbers, contractors, dealers, retailers or other third parties.

Any claim relating solely to installation workmanship must be directed to the installer or service provider responsible for the installation.

23. PRODUCT DESIGN CHANGES

Sani Canada reserves the right to modify, discontinue or change the design, materials, specifications, colours, finishes or components of its products without notice.

Where a replacement is required under this warranty and the original product is no longer available, Sani Canada may provide a reasonably comparable current product or component.

24. SEVERABILITY

If any provision of this warranty is determined by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be limited or modified to the minimum extent necessary to make it enforceable.

The remaining provisions of this warranty shall continue in full force and effect.

25. GOVERNING LAW

This warranty shall be interpreted in accordance with the laws applicable in the jurisdiction in which the product was purchased and installed, subject always to mandatory consumer-protection legislation and other applicable laws.

Nothing in this warranty is intended to deprive a consumer of rights that cannot legally be waived.

26. ENTIRE WARRANTY

This document constitutes the Sani Canada limited product warranty applicable to the products identified herein, except where a separate written warranty issued by Sani Canada specifically applies to a particular product.

No employee, retailer, distributor, installer or other person is authorized to modify or extend this warranty on behalf of Sani Canada unless such modification or extension is expressly authorized in writing by Sani Canada.

  7. Retain your proof of purchase and installation documentation.

Installation of the product constitutes acceptance of the applicable installation requirements and care instructions, subject to rights that cannot legally be waived.
